ARUDA The defendant was charged with rape by intoxication with a prior strike conviction for robbery. The defendant was found in bed with a 15 year old girl by the victim’s father. Both were intoxicated. The victim told police that she had sex with the defendant. The police’s forensic evidence included the defendant’s pubic hair found inside victim’s vagina and the victim’s DNA found on the defendant’s penis. The defendant was facing a minimum of 21 years in state prison. After proceeding to trial, the jury returned a verdict of NOT GUILTY OF RAPE BY INTOXICATION. PEOPLE V. GREEN The defendant was charged with possession of child pornography. Police received a tip from a computer repair person that the defendant’s computer contained child pornography. The police investigated and went to the defendant’s home. The defendant agreed to allow the police to search his computer. The computer was seized and the FBI forensic lab searched the entire computer hard drive. The search revealed more than 300 pictures depicting child pornography. David E. The defendant was alleged to have molested the daughter of his neighbor who was eleven at the time of the initial acts on at least six different occasions. The defendant also sent flowers and love letters to the alleged victim. A jury trial resulted in NOT GUILTY ON FOUR COUNTS with the Jury deadlocked on the remaining counts.
